Bush Intervenes in Ohio Voter Dispute

Legally, don't "provisional ballots" have to be counted if found to be valid? How can there be a legal exception? Isn't any election result subject to challenge if those ballots exceed the difference in votes between the leading candidates? What court could justify refusing such a legally valid challenge? The Dumbocrats certainly have enough lawyers and funds to take every such voter-suppression case to court.
